Here’s how the program works: Spend $100 during a shopping trip to Hiller’s, and automatically qualify for a Hometown First card. You’ll obtain your card at the service desk, using your receipt as proof of your purchase totals. A store manager will give you a Hometown First card, which is redeemable for ONE TIME USE at a participating business. Participants are listed in detail and with the explanation of their particular discounts on the Hiller’s website and also at the service desk of each Hiller’s store. The Hiller’s Hometown First card will be used like a coupon at a participating business. The business will keep the card since it is only redeemable once. Together, we will rebuild our economy. Please read these Terms and Conditions carefully and retain them for future use. A copy of these Terms and Conditions is available online at www.Hillers.com. 1. Definitions. As used in these Terms and Conditions, “Merchant” means a business that has agreed to accept Cards for a discount. “Cardholder” or “You” means the holder of a Card, and all subsequent holders who have received the Card by gift or otherwise. “Hiller’s” means Hiller Incorporated, a Michigan corporation. 2. Use of the Hiller’s Hometown First Program Card. Hiller’s has partnered with local Merchants to offer discounts to Hiller’s shoppers. Subject to the restrictions stated in these Terms and Conditions, each Card is usable by a Cardholder to receive a discount when purchasing goods or services at participating Merchants. Each time you spend $100 or more at Hiller’s Market, you will be entitled to receive a Card at the time of purchase. 3. Participating Merchants. The list of Merchants participating in the Hometown First Program is constantly changing. Due to circumstances beyond Hiller’s control, Merchants periodically drop from the program or change their discount offer. At the same time, new businesses may join the program. For an updated listing of participating Merchants and discount offers, or to request information about participating Merchants, please visit www.Hillers.com or call 1-248-355-2122. If a Merchant does not appear on the website, it is no longer participating in the program. You are not entitled to a discount if a Merchant has dropped out of the program, so be sure to check the website frequently. 4. Use Limitations. Use of a Card constitutes acceptance of these Terms and Conditions. The Card is not a gift card or gift certificate and is not returnable or redeemable for cash. You may not redeem a Card for a discount at any non-participating Merchant locations. You may use each Card only once to receive a discount at a participating Merchant location. Hiller’s may terminate your use of a Card at any time without notice for any reason. You must present your Card to your server at participating Merchants prior to placing your order. Merchants reserve the right to exclude the use of the Card for purchases during happy hour, take-out, deliveries, alcohol, groups larger than six people, special events and holidays. Discounts cannot be combined with any other offer or promotion and exclude tax and gratuity. The Card program may be terminated at any time without notice. The sale, barter, trade, purchase or transfer for compensation of a Card by any person or entity is strictly prohibited. The Card is intended for the personal use of the individual Cardholder who received the Card from Hiller’s. Any use or offer in violation of these Terms and Conditions shall render the Card void. Cards may not be reproduced. Each Card may be used only once. Merchants will be instructed to collect and destroy each Card upon its acceptance and honor. 5. Receipts and Statements; Error Resolution. When you use a Card, the participating Merchant should provide you with a receipt similar to that received with any other purchase. Please check your receipt to verify the amount is correct. If the amount is incorrect, you must notify the Merchant to correct the error. Hiller’s is not a Merchant or the supplier of goods or services purchased at a discount with the Card. If you have a problem with a purchase or a dispute with a Merchant, you must deal directly with the Merchant. Hiller’s is not responsible for the goods or services purchased at a discount with the Card, including their sale, quality or fitness. Hiller’s is not liable if a Merchant changes the discount offer or fails or refuses to accept a Card. This may occur because of change of ownership, management, a misinformed employee or for other reasons. 6. Release and Limitation of Liability. Cardholder shall release Hiller’s, its owners, managers, officers and agents, harmless from any liabilities, claims, demands, suits, losses, damages, costs and obligations that Cardholder may now or in the future have that arise out of or in connection with the Card or Hiller’s Hometown First Program. Hiller’s disclaims all warranties, written or oral, statutory, express, or implied. Any returns or exchanges to a Merchant shall be governed by the policies of each Merchant and applicable law. Each participating Merchant is responsible for resolving any errors in transactions occurring at such Merchant location. You will not receive a periodic statement listing transactions that you make using Cards. Hiller’s is not responsible for lost, stolen or damaged Cards or any unauthorized use. Hiller’s does not warrant or represent that its Card program will be uninterrupted or error free and it will not be liable for resulting damages. 7. Void Where Prohibited by Law. All provisions of these Terms and Conditions are void where expressly prohibited by law. If any provision of these Terms and Conditions are determined to be illegal or unenforceable, that provision will be eliminated or adjusted to the minimum extent necessary so that these Terms and Conditions shall otherwise remain in full force and effect and enforceable. 8. Governing Law; Venue. These Terms and Conditions shall be governed by and construed exclusively in accordance with the laws of the State of Michigan notwithstanding any conflict of law rules. With respect to any dispute related to these Terms and Conditions, you agree to submit to the exclusive jurisdiction of the state courts located in Oakland County, Michigan or federal courts located in Wayne County, Michigan. 9. Waiver of Punitive Damage Claims and Class Actions. You waive all rights to pursue any claims on a class or consolidated basis or in a representative capacity. You will not join any claim with the claim of any other person or entity. You waive, to the fullest extent allowed by law, any claims to recover punitive or exemplary damages. 10. Entire Agreement. These Terms and Conditions are the complete and exclusive statement of agreement between Cardholder and Hiller’s regarding the Hometown First Program Card. |
